Freehold Sales & Purchases

What Is A Freehold Sale / Purchase?

Freehold means you own the property and the land it stands on outright. If you’re buying a freehold, you’ll become the full legal owner with no ground rent or lease to worry about. If you’re selling one, you’re passing that full ownership to someone else.

This is the most common type of ownership for houses.

Selling A Freehold Property

Selling a freehold property usually involves fewer legal steps than a leasehold. The process includes gathering title documents, drafting contracts, handling enquiries from the buyer’s Solicitor and arranging completion.

  • How much you can sell your freehold for depends on market value, any agreements in place, and whether it includes other interests like garages or shared access.
  • Most freehold sales take between 8 to 12 weeks from offer to completion, depending on the buyer, chain and mortgage approvals.
  • You can negotiate the sale price of your freehold just like any other property. However, once contracts are signed, changes are rarely possible.

Leasehold Sales & Purchases

What Does It Mean To Buy / Sell Leasehold?

With leasehold, you own the property but not the land it sits on. That land is owned by a Freeholder. The lease gives you rights to use the property for a set number of years.

You can sell or buy a leasehold property in much the same way as a freehold property, but there are extra legal steps. These include reviewing the lease terms, checking ground rent, service charges, and getting information from the Managing Agent or Freeholder.

Common Concerns With Leasehold Transactions

  • Leasehold properties are perfectly legal to buy and sell, but issues can arise if leases are short, fees are unclear, or Managing Agents are slow to respond.
  • A 999-year lease is seen as very secure and often treated like freehold in practice. Still, it’s important to check lease clauses carefully.
  • Many Clients ask if leasehold will be abolished. There are proposed changes in government, but leasehold still remains legal and common - especially with flats and apartments.

Remortgages

Legal Support For Remortgaging Your Property

If you’re switching to a new Mortgage Lender, legal work is needed to update your title and register the new loan. This includes paying off your old mortgage, handling Lender documents, and updating the Land Registry.

This is the most common type of ownership for houses.

How We Work

  • We handle this process on your behalf, working under Taylor Rose - a fully regulated Solicitors’ firm. You’ll deal with us directly throughout, with clear updates and personal support every step of the way.
  • Most remortgages are straightforward but delays often happen when communication is poor. We make sure you’re kept informed and everything stays on track.
  • We move quickly, keep you updated and avoid jargon. We work closely with Lenders and Brokers to make sure everything is lined up for your completion date.

Transfers Of Equity

What Is A Transfer Of Equity?

This means changing who legally owns part or all of a property. Common reasons include relationship changes, gifting property to family, or adjusting ownership for tax purposes.

These changes may seem simple but often involve Lender consent, Stamp Duty checks, or restrictions on title.

Our Approach

We’ll explain your options clearly, prepare the documents, and make sure everything is registered correctly. If there’s a mortgage involved, we’ll handle the Lender’s requirements too.
